Question about employment and granting a leave of absence?


Leslie works for a computer company. She is the project manager and supervisor for revamping a large hotel centralized reservations computer system. Leslie found out that her child got into an accident and will need to stay in the hospital for one week and will need an additional four weeks for recovery. Leslie requested a four week leave of absence. The computer company is reluctant to grant the leave because they need her for the hotel revamping which is in a critical stage of development. Does the FMLA require the computer company to grant the leave for Leslie? Explain.

FMLA does not require her employer to grant her leave request.





FMLA protects the employee from any discrimination from being absent from work for qualified leaves due to illness, birth of a child, caring for a sick child, etc.





However, there are certain guidelines which need to be met, such was working a certain number of hours to be eligible for protection under FMLA.
